STATE OF NEBRASKA
DEATH BENEFITS

STATE DEATH BENEFITS
No one-time state death benefit is available.
STATE PENSION BENEFITS
Pension benefits differ from department to department. Check with your local agency to see what
pension plan your family may be eligible to receive benefits from.
EDUCATION BENEFITS
None Available.
HEALTH BENEFITS
Health benefits vary depending upon your local department’s benefits package.
WORKERS’ COMPENSATION
Workers’ Compensation coverage is compulsory for employers in Nebraska; however, waivers are allowed.
Benefit is 66 2/3% of employee’s wage for a spouse and 75% for spouse with child(ren) with a minimum
weekly benefit of $49 or actual wage if less than $49 and a maximum weekly benefit of $350. Starting
January 1, 1996, the maximum weekly benefit will be 100% of the State’s Average Weekly Wage. There
is also a maximum burial allowance of $2,000.
Two-year lump sum payable to spouse upon remarriage and weekly benefits cease. Children receive
benefits until age 18 or beyond age 18 if disabled, or until age 25 if full-time students.
To receive workers’ compensation benefits the surviving spouse must take the initiative and file a work-
ers’ compensation claim through a workers’ compensation attorney to receive any compensation. The
determination as to whether the claim will be paid will be determined by the Workers’ Compensation
Appeals Board.

PERSONAL LIFE POLICY
Uniform Probate Code adopted as Nebraska Probate Code at 30-2201 et. seq.
Escheat - If decedent leaves no surviving spouse or kindred his real and personal property escheats to state.
(30-2305).
Uniform Disposition of Unclaimed Property Act adopted.
Personality - Can be passed by separate written list (30-2338), or collected and distributed by affidavit
when value of net estate does not exceed $10,000. (30-24,125).
Real Property - Deed of distribution of real property must be recorded with register of deeds. (30-24,
105).
